      THE NAME OF GOD Amen this 3d, day of November 1729; We the within WILLIAM and JANE MEKENNE of NOMINY of Copeley Parrish in the County of Westmoreland being sick and weak in body but of perfect mind and memory, considering the uncertainty of mortality, doe here make and ordaine our Last Will and Testement in manner and form as followeth first revokeing and making void all former Wills and Testements whatsoever;
      First, We give and bequeath our Souls into the hands of God that gave it and our bodys to the Earth to be decently buried according to the discretion of our Executors hereafter named.
      Item. We give and bequeath our Lands and plantation to be equally devided between our three Sons, GERRARD, JOHN and DANIEL and if either of them should decease without heir, our Will is that it should fall to the other two and if any two die without heir then all to fall to one; which land and plantation we give and bequeath to them and their heirs for ever lawfully begotten of theire bodges only we give free priveledge for any of them or either of them to sell their part or persell of land to each other as they shall think fits;
      Item. I give and bequeath unto my Son, WILLIAM MEKENNY one Heffer of three years old and one Shilling Sterl, in full of our Estate;
      Item. I give unto my Grand Child, KENNE WILLIAMS, one Heffer of three years old after our decease;
      Item. Wee give and bequeath to our three Daughters, DEBORAH MARMEDUKE, JANE WILLIAMS and MARY WILLIAMS one Shilling Sterling apeice which Shilling to be paid by our Execotors to every one of them in full of our Estate.
      Item. We doe here make constitute and appoint our two beloved Sons, GERRARD and JOHN MAKENNE, Executors of this our Last Will and Testement; In Witness whereof we have both set our hands and seales the day and year above written

      Westmorland ss. In Obedience of an Order of Court bearing date ye 24th day of February 1735, We the Jurymen according to the directions of ye sd. Order & first sworn before HENRY LEE, Gent., to lay off and sett the bounds of Land in difference between DANL: McKENNEY, MARY SMITH, Widw: & WM, GARRARD and in pursusance of the same & in company of JAMES THOMAS, Surveyor of the said County, we went to the begining corner tree a white Oak lying on the ground wch: by the evidence of WM FRYER, ELIAS DAVIS and DANL: JACKSON being first sworn who severally deposed that four years past being appointed processioners to procession certain Lands within their precincts came to a corner tree belonging to JAMES HARDWICH wch: sd, corner tree they verily believe to be the corner tree of ye land now in difference between the sd. DANL, McKENNEY, MARY SMITH, Widw., & WM. GARRARD and upon viewing of a Deed of Sale wch: said DANL: McKENNY produced from HENRY DURANT unto RICHARD WHITE bearing date the 26th day of November 1670 under wch: he claims we began to lay off the Land according to the said Deed, begining at the aforesaid corner tree running North West two hundred poles to a Stake in the angle of two white and one red Oak saplins markt, faceing inwards, thence runing North East eighty two and half poles to a red Oak corner tree wch: is sixteen & half poles more than the said Deed mentioned in order to give One hundred acres of Land as by said Deed nominates, from thence South East one hundred eighty eight poles to a Stake in the line of JAMES HARDWICH, from thence So, 33d. oo West along the said line twenty two & 1/2 poles, thence So. 38d oo West sixty poles to the beginning corner tree, including one hundred acres of Land as is specified in ye sd. Deed wch: we referr to the Surveyors Plot &Report. Given

      In Obedience to an Order of the said County Court bearing date the 25th day of February last past for settling the bounds of Land between DANIEL McKENNY, MARY SMITH and WILLIAM GARRARD, I the Subscriber in company of a Jury sworn according to Law mett on the Lands in controversy on the day appointed in the said order and proceeded to survey and lay off the same according to the directions of the said jury as followeth. tvizt,) First the said DANIEL McKENNY produced a Deed of Sale from HENRY DURANT and his Wife to RICHARD WHITE for one hundred acres of Land bearing date the 26th day of November 1670, under which he claims, and showed its begining to be an old white Oak lying on the Ground mentioned in the Jury's Report by the Deposition of WILLIAM FRYER, ELIAS DAVIS and DANIEL JACKSON, who were sworn to give their evidence severally deposed that about four years past being appointed processioners to procession certain Lands within their precincts came to the said white Oak corner to the land of JAMES HARDWICH and that they verily believe the same to be corner of the lands now in difference between DANIEL McKENNY, MARY SMITH and WILLIAM GARRARD from thence extended the first course of said Deed of Sale North West 200 poles to a Stake in the angle of two white and one red Oak saplings marked fceing inwards, thence North East 66 poles being the course and number of poles specified in the said Deed but includes but eighty two & half acres and the said McKENNY alledging that his being the Elder Sale ought to include one hundred acres and the said MARY SMITH & WILLIAM GARRARD not appearing nor any of their papers being produced, the Jury ordered the said North East course to be continued to eighty two & half poles to include One hundred acres, thence South East 188 poles to a Stake in the line of JAMES HARDWICH, thence along said HARDWICH's lines South 23d. West 22 1/2 poles South 38d. West 60 poles to the begining including One hundred acres as by the plot amended,

      TO ALL CHRISTIAN PEOPLE to whome these presents shall come, I WILLIAM LAWSON of the Parish of Cople and County of Westmorland in the Colony of Virginia sendeth Greeting in our Lord God everlasting. Whereas I WILLIAM LAWSON for the natural love and affection which I beare towards my Wife's Children, namely, DANIEL MACKINNEY, MARY MACKINNEY and FRANCIS MACKINNEY of the Parish and County aforesaid, I do give unto the said Children and their heirs from the day of the date hereof all my right title claim and demand in and to all the Land which belonged unto DANIEL MACKINNEY, deced., and all the moveables, Negroes and Cash which I was any ways intitled to by marrying their Mother, which the before was intitled to excepting those parts which my Wife pleases to take for her use and mine; To have and to hold all the above mentioned lands, moveables, Negroes and cash unto DANIEL MACKINNEY, MARY MACKINNEY and FRANCIS MACKINNEY to be equaly divided between them and their heirs as aforesaid from me my heirs; In Witness whereof to these presents I have hereunto set my hand and seal this twenty fifth day of May one thousand seven hundred and fifty two
