Executrix: Barbara Birch. === May 24, 1729 - Charles County, Maryland Will book Liber CC#2 Folio 725-726 Last Will and Testament of Oliver Burch (father of Anne Burch) In the name of God Amen, I Oliver Burch of King and Queen Parish in Charles County being in perfect health& of sound mind and memory blessed be God for the same and calling to mind the uncertainty of this world that there is nothing certain but death and that most uncertain, when do make and ordain this my Last Will and Testament in a manner and form following (Viz) ---- Imprimis: I give and bequeath my soul into the hands of Almighty God that gaveth me- Doubting nothing but that through the merits and intercession of my Blessed Savior and Redeemer Jesus Christ I shall receive it again at the last day with a full pardon of all my sins my body to the Earth to be buried in a Christian like manner at the appointment of Executors hereafter by me named and as for the worldly goods that it hath pleased God of his goodness to endow me with all, I bestow in manner and form the following ~ viz. ~ Item: I give and bequeath to my son Benjamin Burch Seventy Five acres of land it being part of a tract of land called, Bowlings Plains to him and his heirs forever. Item: I give and bequeath to my two sons Thomas and John Burch five shilling sterling a piece. Item: I give and bequeath to my son Edward Burch one feather bed and covering, I give the said goods to my son Edward Burch. Item: I give and bequeath to my son Jonathan Burch the two tracts land the one called Lumley and Penrick, I give to the said land to my son Jonathan to him and his heirs forever. Phillips May 24th 1729 then came George Brett and made Oath on the holy Evangelist that he saw the above named Oliver Burch sign and seal the above and heard him publish and declare the same to be his Last Will and Testament and that at the time of his so doing he was of sound and perfect memory to the best of his Judgement and that no other no other sponsor was called at that time as a witness on subscribed as such. This deed was acknowledged by John Noe and Sarah, his wife === Charles County Court Records, March 1737/8 Court, Liber T#2, Page 425 Pursuant to the order of Mar Court in the 20th year of the dominion of the Proprietary, Commission issued to examine witnesses touching the bounds of a tract of land called Hadley, in possession of Robert Mackhorn. Commissioners appointed: Robert Yates, Andrew Chunn, George Hatton, and Geo: Brett of CC, Gent (not being any way related to the Petr, contiguous Proprietor, nor interested in the sd land). Hadley is in CC. The purpose of the Commission was to prove and perpetuate the memory of the bounds of Hadley. . And now here, at Mar Court, Robert Yates, Andrew Chunn, and George Hatton, return to this Court the Commission afd, with the following depositions and certificate annexed - The deposition of John Briscoe, age about 30, declares that about 10-11 years ago, he was employed by Robt: Mechon to run out a certain tract of land called Hadley, and that as they were running the lines, Oliver Burch met them at the place where the deponent now stands, and showed him a red oak and told him that it was one of the bound trees of Hadley Land, but the deponent can't charge his memory which way sd Burch knew it to be the bound tree. The deposition of Jona: Burch, age about 30, declares that about 10-11 years ago, his father, Oliver Burch, showed him a red oak where the deponent now stands, and told him, sd deponent, that he had heard that Capt. Barton should say that it was one of the bound trees of Hadley Land. We have examined the witnesses brought to us, this Mar 8, 1737/8 - Robert Yates, Andrew Chunn, George Hatton. === Contributed by Ralph D. Smith Oct. 1751 - At a General Meeting of Trinity Parish (Charles Co.) in Oct. 1751, a poll was taken as to where a new church should be built. The two locations proposed were "at a place where Thomas Barron lately lived and the old field near Justinian Burch, Jr. 's." The vote was taken in June 1752, with this result: "for ye place near Barron's - 41 votes; for ye place near Burch's - 50 votes." (not paginated) Comment: As shown by records above and the Aug. 1753 record below, the Trinity Parish Church is built on Oliver Burch's former land. Trinity Parish was created in 1744 out of those portions of King and Queen Parish and of All Faiths Parish that were in Charles Co. Aug. 1753 - Charles Co., Md. Land Records. Justinian Burch, Jr., of Charles Co., planter, and wife Ann, deed to the Revd. Mr. Isaac Campble [sic: Campbell] and his associates, the Vestrymen and Church Wardens of Trinity Parish, for the use of Trinity Parish (whereon to build a Parish Church for the use and benefit of the parishioners), all that part of a tract of land "Lumbley" on the east side of Piles Fresh in the Parish and County aforesaid, containing and now laid out for about 2 acres. Comment: The successor Trinity Church still stands at this same location, enabling one to locate "Lumley," the seated plantation of Oliver Burch. Take Hwy. 6 east from La Plata: turn right at Trinity Church Road and proceed to the Church. The Burch burial plot can be found immediately to the right of the Church. This is where Oliver and Barbara and many of their descendants were buried.
