John Withers, the testator named in the act, is called, in the Stafford records, Captain John Withers, and appears to have been a man of property and standing. He married ***FRANCES, widow of Francis Dade, daughter of Col. Robert Townshend, of Stafford County, and granddaughter of Richard Townshend, member of the Virginia Council (Hayden's Virginia Genealogies, p 732, etc.). After the death of CAPTAIN WITHERS she married Rice Hooe, of Stafford. There is recorded in Stafford a deed dated 8 Sep 1699, from Frances Withers, relict of Captain John Withers, and now about to marry Mr. Rice Hooe, of Stafford, conveying negroes and other personal property to her sons Robert, Francis, and Cadwallader Dade. In the same county is a deed from Rice Hooe, and FRANCES his wife, dated 20 Sep 1699, releasing to William Withers 400 acres in Stafford, called Hollowing Point, which John Withers, deceased, gave to said William Withers. Also a deed dated 19 Feb 1699-1700, from Rice Hooe, who married FRANCIS, relict of Captain John Withers, releasing to Captain Richard Fosaker [who was a Burgess for Stafford in 1703] who married the daughter and executrix of said Captain John Withers, all claims he might have, as marrying the relict of said John Withers, or any sum or sums of money in England or the Colony. The said FRANCIS was entitled to one-third of the money in England, and this had been received by said Rice Hooe."

FRANCIS DADE and FRANCES his wife one of the daughters and coheirs of ROBERT TOWNSHEND late of this County deced and JOHN WASHINGTON as Guardian and next friend to MARY TOWNSEND another daughter and coheir of Robert Townsend deced sheweth that FRANCES TOWNSEND Mother to the said Robert in her widowhood did the 7th day of February 1650 procure a pattent from Sr. WILLIAM BERKLEY Knt. for two thousand two hundred acres of land then Scituate and lying in Northumberland County and now called Stafford County within the Collony of Virginia which land did descend upon Robert Townsend her son and heir Father to your Petrs which said Robert Townsend dyed in the infancy of your Petrs seised and possessed of the said land after whose decease the same of right descends to your Petrs either as grandaughters and coheirs of their grand-mother Frances Townsend (mother to the said Robert their Father) or as co-heirs to the said Father Robert Townsend But now so it is that THOMAS DERRICK JUNR. hath for the Space of six months last past entered into and upon one thousand acres of the said dividend of land part whereof is knowne by the name of Rich neck and breaks up the land and cutts downe the Timber to your petitioners damage five thousand pounds of Tobacco for which your Petrs hath brought their action against Thomas Derrick Junr. and craves Judgment for the same with costs of suit as also their Majesties Writ of habere Facias possessionem to put your petrs in Quiet possession thereof And Thomas Derrick Junr. comes in and vouches JEFFRIE JEFFRIES and JOHN JEFFRIES the heirs and Executors of JOHN JEFFRIES late of London Esqr. deced to be the landlords and of whom and by vertue of whose power he was put into the beforementioned premises having legally Rented and leased the same from the said Jeffries Lawful attorney and prays Licence of Imparlance till the next Court to put in their plea and that he may be then discharged from this action which Licence of Imparlance unto him is granted and that then their plea be not wanting.

Know all men .. that we RICE HOE & FRANCES wife to Rice Hoe relict to Capt. JOHN WITHERS late of this county deced do release any claim unto that 400 acres of land that Capt. John Withers gave WILLIAM WITHERS commonly known by the name Hollowing Point together with all housing, edifices rights and title .. to William Withers .. to have received full satisfaction for the same by a note charged on Cohlo. GEORGE MASON for 500 pounds Tobacco which being paid we do own to be satisfaction for one third part of that land .. 20th September 1699.

February 19th 1699/1700. Know all men .. I RICE ROE of county Stafford gent. who intermarried with the Widow and relict of Capt. JOHN WITHERS deced have clearly discharged Capt. RICHARD FOSSAKER who intermarried with the Excr. daughter of said Withers deced from all claims I may have to sums of money in England or in this Colony which shall be due to me as marrying the Widow and relict of the said Withers deced to whom the third part of all money in England was due .. having raced Bills of Exchange of him for any claim that the children of FRANCIS DADE shall have against him .. (my wife) who was formerly the widow of Francis Dade.

Page 430-437 This Indenture made 12th and 13th June 1727 between SARAH CONWAY of Saint Pauls Parish in county Stafford Widow Daughter of JOHN WITHERS late of Parish & County aforesaid Gent. deced of one part & AUGUSTINE WASHINGTON of Washington Parish Westmoreland County Gent. of other .. Witnesseth that Sarah by deeds of lease & release in consideration sum of one hundred & fifty pounds Sterling money to her she doth sell 532 acres on Chotank Creek in said County being part of a greater dividend of 2200 acres granted by Patent unto FRRANCES TOWNSHEND Widow the 7th February 1650 .. 200 acres part of the above said 532 acres being by the above Frances Townshend sold to one OLIVER BALFE who leaving no heir the same became Escheat and was accordingly granted to Colo. WILLIAM FITZHUGH deced who by deed of sale dated 6th May 1691 sold the same 200 acres unto JOHN WITHERS father of said Sarah Conway .. the said land abutting on Chotank creek at a Place commonly called the Oyster shell landing and bounding on Mrs. MARY TOWNSHEND being the land now in possession of MARY WASHINGTON Widow of JOHN WASHINGTON deced and so marked out with a line of marked trees and 332 acres other part of the said 532 acres desended unto ROBERT TOWNSHEND Son of the above named FRANCES TOWNSHEND and from him unto FFRANCES his Daughter who Intermarried with one FFRANCIS DADE which said Francis Dade & Ffrances his wife by the Deed of sale dated 9th Sept 1687 conveyed same to JOHN WITHERS ffather to abovementioned SARAH CONWAY said 332 acres being bounded beginning at white oak on South side of Chotank creek .. down said creek as by a survey made by Mr. WILLIAM HORTON Surveyor of the County of Stafford dated 9th July 1687 and may appear both parcels of land containing 532 acres descended and conveyed unto John Withers .. said John did by his Last Will & Testament dated 29th August 1698 give to his daughter SARAH WITHERS now Sarah Conway party to these presents by said will ..
