Son: Notly Smoot a young mare, saddle, & etc.
Son: William Mattox Smoot a horse, saddle, & etc.
Son: Thos. st. Henley Smoot a colt, saddle & etc.
Dau: Mary Ballenger 5 shilling cash she having already received sufficient proportion of my estate.
Wife: Elizabeth all my negroes & stocks and remainder of my estate during her widowhood and at her marriage or death I give sd. negroes, stocks and sd. estate to be equally divided between my sons Henry Smoot, George Mattox Smoot, James Mattox Smoot, and the child my
wife now pregnant with.
Child: If negroes increase so that there should be one for each of all my before mentioned children except Mary in that case sons: Notly, Wm. Mottox, and Thos. St. Henly each of then out of the increase one negroe.
Notley first choice, Wm. next and then Thos.
Exorx: Wife. If she shall marry I appoint Notly and Wm. Mottox exor.

Thomas Smoot
(1742 - 1783)
Thomas Smoot, son of William and Eleanor Smoot, was born December 1742, in Charles County, Maryland. During the early days of the Revolutionary War he served as a private in the company of Captain Yates of the militia of Charles County--and as there is also a record of a Sergeant Thomas Smoot, perhaps he also served in that capacity. After his service in the Maryland militia, he settled in Prince William County, Virginia.
After 1763 he married Elizabeth ----. The fact that he gave the family name of Maddox to three of his sons would indicate that either his mother or wife were of that family--probably his mother, for it is traditional that his wife was of Middleton lineage.

4. Mary Smoot married Samuel Ballenger, Oct. 20, 1779, by Rev. Joseph Threlkeld, Mont. County, Md.

8. Posthumous child.
His will was dated May 20, 1783, and probated on July 7, 1783, by James Ewell, Gent., George Samkin, Prestley Petty, James Brown, and William Petty. He devised personalty to his sons Notley, William Mattox, and Thomas St. Henley Smoot. To his daughter Mary Ballenger, he left five shillings inasmuch as she had already received a sufficient portion of his estate. The residue was bequeathed to his wife Elizabeth during life, then to be divided among his sons--Henry, George Mattox, James Mattox, and an unborn child.

Thomas Smoot's Will. Jul 5, 1777. I, Thomas Smoot
of CC, am sick and weak of body but of perfect mind and memory.
To my son William Barton Smoot - 1 Negro lad, David, and 1 Negro girl, Eleaner.
To my son Thomas Smoot - a tract of land called Skiplon, lying in CC, containing 200 acres. Also, 1 Negro woman, Jane, 1 Negro boy, Edward, 1 Negro man, Toney, and 1 Negro boy, Walter.
To my son John Smoot - a tract of land called Smoots Fish Pond, lying in CC, containing 118 acres, which was added by resurvey to part of 2 other tracts, the one called Johnson Town, the other, Shife Cut; by sd resurvey is now called Smoots Venture. Also, 1 Negro lad, Stephen, 1 Negro woman, Catherine.
To my daughter Sarah Barnes during her natural life, and after her death to her 3 daughters, viz, Elizabeth, Eleanor, and Victoria Barnes to be equally divided
between the daughters - 1 Negro man, Benjamin, and 1 Negro girl, Elizabeth.
To my daughter Eleanor Barnes - 1 Negro man, John, and 1 Negro girl, Milley, to be disposed of as she may think proper.
To my daughter Catherine Smoot - 1 Negro boy Henry, 1 Negro girl, Grace, 1 Negro man, Roger, and 1 Negro boy, Robert.
I want all of my children above mentioned to have the use of my pew in Portobacco Church. After my debts are paid, the rest of my estate, consisting of stock, furniture, corn, tobacco, and other moveables not before mentioned, are to be equally divided between my 6 children.
Executors: my sons William Barton, Thomas, and John Smoot.
Signed Nov 10, 1775 - Thomas Smoot. Wit - Frans Ware, Ed Scott Ware, Walter Morris, Isaac Smoot.
On Jul 5, 1777, came witnesses Francis Ware, Edward Scott Ware, and Walter Morris to the will of sd Thomas Smoot, deceased, and made oath that they saw the afd testator sign and seal the same. Probate was taken, William Barton Smoot, the heir at law to the deceased being present, did not object to the taking of the same.

Charles County MD Will Book 1777-1780; Page 30. On Jul 5, 1777, Letters Testamentary were granted on the estate of Thomas Smoot to William Barton Smoot and Thomas Smoot, two of the executors, John Smoot, the other executor, being dead. Securities = Edward Scott Ward and Walter Morris of CC. Bond = 2500 £Appraisers: Jno Hanson yst & Hen Massey Hanson. On Sep 30, 1777, the inventory was received, appraised at 1263 £8 shillings 3 pence.

Present: Messrs. Daniel Jenifer, John Dent, Robert Young. Walter Hanson, Register.
Matthew Barnes, who married one of the daughters and representatives of Thomas Smoot, deceased, complains to the Court that William Barton Smoot and Thomas Smoot, executors of sd deceased's, have delayed passing their final account on sd deceased's estate by which means it remains uncertain what he is to receive for his wife's share and prays the Court to order citation against the executors afd at next Court to show cause why they do not have a final account according to the tenor of the Letters Testamentary to them granted thereupon. The Court ordered citation accordingly.

To have and to hold, sd parcel, to sd Thomas Smoot and to the heirs of his body lawfully begotten, and in case of the failure of such heirs, sd land is to become the property of my son, John Smoot.
